The Salt Lake County DA is seeking to vacate Adrian Gordon's 2001 murder conviction due to trial fairness issues.
SALT LAKE CITY – The Salt Lake County District Attorney is working to vacate the murder conviction of Adrian Whitfield Gordon, who was found guilty over two decades ago. Gordon was convicted in 2001 of murdering 50-year-old Lee Lundskog following a bench trial. He received a sentence ranging from five years to life and was paroled in 2023.
District Attorney Sim Gill has raised concerns regarding the fairness of Gordon's trial, asserting that the legal process was compromised. Four years prior, Gordon's attorney from the Rocky Mountain Innocence Center reached out to the DA's Conviction Integrity Unit (CIU) to re-evaluate the case. The attorney highlighted that shortly after Lundskog's murder, an anonymous caller had identified a different suspect and provided police with their whereabouts. This individual was taken into custody for unrelated warrants but was not connected to the murder investigation in the police reports.
The police report regarding the anonymous tip was filed under a different case number, which led to the lead detective failing to share this critical information with both the prosecution and the defense during Gordon's trial. After a thorough review, the CIU concluded that Gordon's conviction had significant issues that warranted further legal action.
On Monday, DA Gill filed a Petition to Vacate Conviction, emphasizing that while this move does not equate to exoneration, it acknowledges the trial's lack of fairness. "If we, as prosecutors, find evidence that a conviction lacks integrity, we have an ethical obligation to act," Gill stated.
In 2019, FOX 13 News reported on Gordon's case, where he, along with his father and attorneys, maintained his innocence, asserting he did not commit the crime. Gordon expressed his firm belief in his innocence, stating, "I know I didn't do it, and I'd go to my deathbed with that." While the effort to vacate the conviction progresses, the DA's office remains committed to ensuring the integrity of the justice system.
